About Grimdex (Controller) and Definitions

Grimdex acts as the data controller for personal data processed in connection with the Service. For privacy enquiries, contact us at [email protected]. Grimdex is based in the United Kingdom. If we appoint an EU representative or Data Protection Officer, we will update our Privacy Policy accordingly.

Definitions: “Service” means the Grimdex website and apps. “Content” means any material on the Service. “User Content” means content submitted or uploaded by you. “We”, “us” or “Grimdex” refers to the Service provider described above.

1. Community-Created Content

Grimdex is a platform for community-generated content related to miniature collections, painting, and gaming. All content, including images, descriptions, and data, is submitted by users. Grimdex does not create, verify, or endorse user-submitted content and is not responsible for its accuracy or legality.

You acknowledge that:

• You are responsible for any content you submit.
• You must have the rights or permission to upload any content you share.
• If you believe content infringes on your rights, you can report it for review.

2. Intellectual Property and Trademarks

Grimdex is not affiliated with, endorsed by, or associated with any specific company or intellectual property owner. Any references to third-party trademarks, products, or materials are purely descriptive and used under fair use principles.

Users must not:

• Upload or distribute copyrighted materials unless they have permission.
• Misrepresent ownership of content related to third-party intellectual property.
• Use trademarks in a way that suggests affiliation or endorsement.

Third-Party IP Notices

Grimdex is not endorsed by, affiliated with, or sponsored by any third party. References to products and marks are for descriptive purposes only. In particular, Warhammer, Warhammer 40,000, Age of Sigmar and related marks are trademarks of Games Workshop Limited; Grimdex is not endorsed by or affiliated with Games Workshop. Users must not upload or distribute any third-party proprietary content without permission, including paid rules text, datasheets, points values, book scans, or other proprietary materials (e.g., from Games Workshop publications). If any rights holder notifies us of an infringement, we will act in accordance with our notice-and-takedown process.

3. Liability Disclaimer

Grimdex provides the Service "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or availability of content. By using Grimdex, you agree that:

• Grimdex is not liable for any user-generated content.
• We are not responsible for any disputes arising from content submission or use.
• You use the Service at your own risk.

To the maximum extent permitted by law, Grimdex and its owners are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.

4. Content Moderation and Removal

We reserve the right to remove or restrict access to any content that violates these Terms, applicable laws, or third-party rights. We also reserve the right to suspend or terminate accounts that repeatedly violate these policies.

If you believe content on Grimdex infringes on your copyright, please submit a takedown request by contacting us at [email protected] with the following details:

• A description of the copyrighted work you claim is infringed.
• A link to the infringing content.
• Your contact information.
• A statement that you have a good-faith belief that the use of the content is unauthorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

5. Privacy Policy

Your use of the Service is subject to our Privacy Policy. Please review it carefully at /privacy.

6. Changes to These Terms

Grimdex may update these Terms at any time. We will notify users of significant changes, but it is your responsibility to review these Terms periodically. Continued use of the Service after updates constitutes acceptance of the new Terms.

7. Eligibility and Account Security

You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

8. Acceptable Use

You agree not to misuse the Service. Prohibited uses include:

• Violating any applicable law or regulation.
• Infringing, misappropriating, or violating intellectual property, privacy, or publicity rights.
• Harassing, threatening, or promoting violence or hate against individuals or groups.
• Uploading malware or engaging in activity that disrupts or harms the Service or its users.
• Scraping, crawling, or using automated means to access the Service without prior written permission.
• Attempting to bypass security or access non-public areas or data.
• Uploading sexual content involving minors or any content that sexualises minors.
• Doxxing or posting others’ personal data without consent.
• Uploading proprietary content without permission.
• Spamming, deceptive practices, or attempts to manipulate rankings or visibility.

9. User Content License

You retain ownership of your User Content. By submitting User Content to Grimdex, you grant Grimdex a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, adapt for technical formatting, publicly display and distribute such content to operate, provide, and improve the Service, including promotional and marketing activities such as showcasing content in social media posts, marketing materials, and other promotional channels.

You are solely responsible for ensuring that your User Content does not infringe upon any third-party intellectual property rights, including but not limited to copyrights, trademarks, patents, or trade secrets. You warrant that you have all necessary rights, permissions, and licenses to submit your User Content and grant the license described above. This includes compliance with any third-party intellectual property policies, guidelines, or terms of service that may apply to content featuring their products, characters, or settings.

You may withdraw permission for promotional use of your User Content at any time by contacting support at [email protected]. Upon withdrawal, we will cease new promotional uses and, where feasible, remove your User Content from our own channels within a reasonable period (typically within 30 days). This does not affect materials already printed or distributed, or third-party re-shares beyond our control.

To the extent permitted by law, you waive any moral rights you may have in your User Content solely for the purposes described above.

10. Notice-and-Takedown (UK/EU)

Grimdex is a hosting provider of user-generated content. If you believe material on the Service is unlawful or infringes your rights, please notify us at [email protected] and include: (a) a description of the work or right claimed to be infringed; (b) the URL or location of the material; (c) your name and contact details; (d) a statement explaining why you believe the material is unlawful; and (e) a statement that the information in your notice is accurate. We will act expeditiously where appropriate (which may include removal or restriction) and may notify the uploader. We reserve the right to request further information to assess your notice.

Grimdex operates a repeat-infringer policy and may suspend or terminate accounts that repeatedly upload unlawful or infringing content.

If you believe content was removed in error, you may submit a counter-notice explaining why the material is lawful. Where appropriate, we may reinstate content. Submitting false, misleading or bad-faith notices or counter-notices may result in account action.

11. Third-Party Services

The Service integrates third-party providers to operate core features (e.g., hosting, authentication, media storage, email delivery, analytics, and error monitoring). These include, for example, Vercel (hosting and edge network), Supabase (authentication/database), Cloudflare R2 (media storage/CDN), Brevo (email), Google Analytics and Vercel (analytics), and Sentry (error monitoring). Grimdex is not responsible for third-party services and does not control their practices; your use is subject to their terms and policies.

12. Indemnification

You agree to indemnify and hold harmless Grimdex and its owners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms. This includes, but is not limited to, any claims of intellectual property infringement, copyright violations, trademark disputes, or other third-party rights violations arising from your User Content or your failure to comply with applicable third-party intellectual property policies or guidelines.

13. Limitation of Liability

To the maximum extent permitted by law, Grimdex and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event will Grimdex’s aggregate liability exceed the greater of one hundred (100) GBP or the amount you paid to Grimdex in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law. If you are a consumer, your statutory rights are not affected.

14. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or users. Upon termination, your right to use the Service ceases immediately. Certain provisions that by their nature should survive will survive termination (including, without limitation, ownership, disclaimers, indemnification, and limitations of liability).

Where feasible, you may request an export of your User Content before closure. We may retain limited records as required by law.

15. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales. You and Grimdex agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your country of residence.

16. Dispute Resolution

Before issuing proceedings, the parties will use reasonable efforts to resolve disputes informally. If not resolved within 30 days, the parties agree to consider good-faith mediation. Nothing in this section limits either party's right to seek urgent injunctive or equitable relief from the courts of England and Wales.

17. Export Controls

You represent that you are not located in a region embargoed by your applicable jurisdiction and are not on any government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.

18. Feedback

If you submit comments, ideas, or suggestions, you grant Grimdex a perpetual, irrevocable, worldwide, royalty-free license to use and exploit the feedback without any obligation to you.

19. Miscellaneous

These Terms constitute the entire agreement between you and Grimdex regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, acquisition, or sale of assets.
